1. Introduction
This document sets out the general terms and conditions that govern access to and use of the Arberion platform — a digital infrastructure for trading cryptocurrencies, digital assets, financial derivatives and other instruments based on blockchain technology.
By accessing, registering on, or using the Arberion platform, you acknowledge that you have read, understood and fully agree with the provisions of this document, including operational rules, risk policies, identity verification procedures, illicit activity prevention rules and any other applicable conditions.
2. Acceptance of terms
Use of the platform implies full and unrestricted acceptance of this document and of any complementary policies published by Arberion.
If you do not agree, in whole or in part, with any provision of this document, you must immediately stop using the platform and refrain from creating or maintaining an active account.
3. Definitions
For the purposes of this document, the following terms have the meanings indicated below:
- Arberion: the brand, platform, application, website, systems, services and digital environments operated under that name.
- Platform: the set of interfaces, systems, tools and features provided by Arberion.
- User: a natural or legal person who accesses, uses or registers on the platform.
- Account: the individual registration created by the user to access the services.
- Digital assets: cryptocurrencies, tokens, stablecoins, utility tokens or any assets based on blockchain or similar technology.
- Trading: the act of buying, selling, converting, swapping, custodying, transferring or contracting products related to digital assets.
- Services: all features offered by Arberion, including spot trading, derivatives, staking, API, copy trading and any other services that may be made available.
4. Eligibility
To use the Arberion platform, you must:
- be at least 18 years old or have reached the legal age of majority in your jurisdiction;
- have full legal capacity to contract;
- not be located in a jurisdiction where the use of the platform is prohibited, restricted, or subject to a specific license that you do not hold;
- comply with the laws, regulations, foreign exchange rules, tax obligations and any other applicable requirements in your jurisdiction.
Arberion may restrict or prohibit access to the platform in certain countries, regions, territories or user profiles for regulatory, contractual, operational, reputational or risk management reasons.
5. Registration and account creation
To use the services, you must register by providing true, complete, accurate and up-to-date information.
You agree to keep your information accurate and current at all times, and you are responsible for any harm caused by providing false, incomplete, inaccurate or outdated information.
Arberion may refuse registration, request additional documents, suspend the account opening process or cancel existing accounts whenever it identifies inconsistencies, suspicions of fraud, regulatory non-compliance or any relevant risk.
6. Responsibility for credentials and account
You are fully responsible for the safekeeping, confidentiality and use of your password, login, authentication codes, API keys and any other means of accessing your account.
You agree to:
- use strong and unique passwords;
- not share your credentials with third parties;
- use trusted and protected devices;
- immediately report any suspicion of intrusion, misuse or compromise of your account.
Unless required otherwise by law, all activity carried out from your account is presumed valid and your responsibility.
7. Account security
Arberion may implement security mechanisms, including:
- two-factor authentication (2FA);
- biometric authentication;
- email confirmation;
- SMS confirmation;
- access behavior analysis;
- preventive blocks and security reviews.
These measures do not entirely eliminate the risks inherent to the digital environment. You acknowledge that account security also depends on your own conduct, the protection of your devices and the prevention of phishing, social engineering, malware and unauthorized access.
8. Services offered
Arberion may, at its sole discretion, make available the following services, among others:
- spot trading of digital assets;
- asset conversion;
- internal or external transfers;
- digital wallet;
- staking;
- lending;
- earn programs;
- copy trading;
- derivatives, futures contracts, margin and leverage;
- API integration;
- promotional campaigns, bonuses or loyalty programs.
Making any service available does not create an obligation of permanent maintenance, and Arberion may change, suspend or discontinue it at any time.
9. Trading of assets
The platform may make markets and trading pairs available based on technical, commercial, regulatory and liquidity criteria.
Order types may include, depending on availability:
- market orders;
- limit orders;
- stop-loss orders;
- take-profit orders;
- algorithmic orders;
- derivatives and futures.
Arberion does not guarantee immediate execution, a specific price, market depth, continuous liquidity, price stability or uninterrupted availability of any asset, pair or feature.
10. Listing and delisting of assets
Arberion may, at any time and without mandatory prior notice, list, suspend, restrict, remove or discontinue digital assets, markets, pairs or products.
The decision may result from factors such as:
- regulatory risk;
- low liquidity;
- technical failures;
- security risks;
- suspicion of manipulation;
- changes in the asset's project structure;
- commercial or reputational considerations.
You acknowledge that delisting an asset may affect its trading, liquidity, price and the ability to withdraw within a defined period.
11. Fees and charges
Use of the platform may involve the collection of fees, tariffs, spreads, operating costs, financing charges, commissions and other amounts related to the services.
These costs may include, among others:
- trading fee;
- deposit fee;
- withdrawal fee;
- custody fee, where applicable;
- liquidation fee;
- funding fee;
- conversion fee;
- special service fees.
Whenever possible, the amounts will be displayed before the operation is confirmed, and Arberion may change them at any time by updating its price list, policies or operating environment.
12. Market risk
You acknowledge that trading digital assets involves significant risks and may result in substantial losses, including the total loss of invested capital.
These risks include, without limitation:
- extreme price volatility;
- low liquidity;
- counterparty risk;
- technological failures;
- smart contract failures;
- cyber attacks;
- regulatory changes;
- sudden market swings;
- asset delistings;
- systemic events and force majeure.
Arberion does not provide financial, legal, accounting or tax advice, nor does it guarantee profit, return, asset preservation or any positive outcome.
13. Derivatives, futures, margin and leverage
Where available, derivatives, futures contracts, margin trading and leverage mechanisms involve risks that are significantly higher than spot trading.
You acknowledge that these operations may result in:
- automatic liquidation;
- accelerated loss of capital;
- the need to add additional margin;
- compulsory closure of positions;
- losses greater than the amount initially allocated, where the structure of the product allows.
Arberion may require suitability assessments, acceptance of specific terms, verification of prior experience and additional eligibility requirements to access these products.
14. Staking, lending, earn and yield services
Staking, lending, earn programs and similar services may involve temporary lock-up of assets, market risk, technological risk, protocol risk and counterparty risk.
Arberion does not guarantee fixed, predictable or continuous returns, nor does it ensure the maintenance of APY, rewards, terms or conditions originally displayed.
You acknowledge that external events, protocol changes, technical failures, partner discontinuation and regulatory changes can impact the results and availability of these services.
15. Copy trading
Where available, copy trading is merely a tool for replicating trading activity. It does not constitute personalized recommendation, investment advice or a promise of performance.
You acknowledge that:
- past performance of third parties does not guarantee future results;
- copied strategies may generate total or partial losses;
- delays, execution divergences and price differences may occur;
- final responsibility for decisions remains with you.
16. API and automated trading
Arberion may provide an API for integration with external software, bots, automated strategies and third-party systems.
You will be fully responsible for:
- protecting your API keys and permissions;
- configuring security limits and restrictions;
- monitoring automated activity;
- responding for orders, cancellations, transfers and any other events executed via API.
Arberion is not responsible for losses arising from programming errors, logical failures, misuse, inadequate integration, intrusion into your systems or actions of third parties connected through the API.
17. Custody, non-custody and wallets
Depending on the service, assets may be subject to custodial, non-custodial or hybrid models.
In custodial services, Arberion may retain operational control of wallets and storage infrastructure. In non-custodial services, you may be responsible for private keys, seed phrases and other control elements.
Arberion is not responsible for losses resulting from:
- sending assets to the wrong network;
- using an invalid address;
- loss of private keys by the user;
- technical incompatibility of protocols;
- user error in moving assets.
18. Deposits, withdrawals and transfers
Deposits, withdrawals and transfers are subject to internal verification, regulatory requirements, operational availability, technical compatibility of networks and security policies.
Arberion may, at its sole discretion:
- impose minimum and maximum limits;
- require additional validation;
- delay or reject withdrawals;
- suspend transactions in case of suspected fraud, technical failure, registration inconsistency or legal requirement.
You are solely responsible for correctly providing addresses, networks, banking information and any other instructions necessary to move assets and funds.
19. KYC — Know your customer
Arberion may require identity verification and registration validation before, during or after account opening.
You may be asked to provide, among others:
- official identification document;
- proof of residence;
- selfie;
- biometrics;
- liveness check;
- proof of source of funds;
- corporate documents, if you are a legal entity.
Refusal, omission or inconsistency of information may result in operational limitations, registration refusal, preventive blocking, suspension or closure of the account.
20. AML, CFT and compliance
Arberion adopts policies for the prevention of money laundering, terrorist financing, weapons proliferation and other illicit practices, in line with regulatory standards, internal controls and compliance policies.
The platform may:
- monitor transactions and behavioral patterns;
- classify user risk;
- request additional documentation;
- temporarily withhold transactions;
- report suspicious operations to the authorities;
- block or terminate accounts.
You declare that you will not use the platform for any illicit activity, directly or indirectly.
21. International sanctions and restrictions
Arberion may restrict access, block operations, deny registration, suspend accounts and refuse transactions involving users, assets, addresses, regions or operations directly or indirectly related to sanction lists, embargoes, international restrictions or determinations of competent authorities.
You declare that you are not subject to sanctions that legally prevent the use of the platform and undertake not to use it for the benefit of sanctioned third parties.
22. Personal data protection
Arberion may collect, store, process, share and use personal and transactional data to the extent necessary for:
- execution of services;
- compliance with legal and regulatory obligations;
- fraud prevention;
- platform security;
- user support;
- auditing and internal controls.
The processing of data complies with applicable legislation and the platform's Privacy Policy.
23. Data sharing
Your data may be shared with:
- regulatory, administrative or judicial authorities;
- KYC and compliance partners;
- technology infrastructure providers;
- financial institutions and payment processors;
- auditors, consultants and operational partners.
This sharing will occur whenever necessary for the provision of services, the security of the platform, compliance with legal obligations or the protection of Arberion's rights.
24. Tax and fiscal obligations
You are solely responsible for assessing, declaring, paying and complying with your tax, fiscal, foreign exchange and ancillary obligations related to use of the platform and operations carried out.
Arberion is not responsible for:
- calculating taxes owed by the user;
- issuing personalized tax declarations;
- individual tax interpretations;
- consequences arising from omissions, errors or default of the user before tax authorities.
25. Prohibited conduct
You are expressly prohibited from:
- committing fraud or attempted fraud;
- manipulating prices, orders or markets;
- using a false identity;
- concealing the illicit origin of funds;
- financing terrorism or criminal activities;
- violating sanctions or embargoes;
- exploiting technical flaws of the platform;
- using bots, scripts or automated means in an abusive manner;
- infringing third-party rights;
- using the platform for any illegal or abusive purpose.
Violation of this clause may give rise to administrative, contractual, civil and criminal measures.
26. Suspension, restriction and account closure
Arberion may, at any time and at its sole discretion, restrict, freeze, suspend or terminate accounts, positions, orders, deposits, withdrawals or features in cases of:
- breach of this document;
- risk of fraud;
- suspicion of illicit activity;
- regulatory requirement;
- registration inconsistency;
- extended inactivity;
- operational, reputational or security risk;
- orders from competent authorities.
Whenever legally possible, Arberion may notify the user of the measure adopted, but this does not constitute an unrestricted obligation.
27. Account inactivity
Arberion may establish rules for inactive accounts, including the charging of an administrative fee, the requirement to revalidate registration, the suspension of features or closure of the account, in accordance with internal policies and applicable legislation.
For contractual purposes, an account is considered inactive when it has had no relevant movement or access for the period defined by the platform.
28. Intellectual property
All software, code, interfaces, brands, logos, layouts, content, documentation, databases, flows, models, tools, texts, images and other elements related to Arberion are protected by intellectual property rights and belong to Arberion or its licensors.
You are prohibited from copying, reproducing, distributing, modifying, licensing, selling, publishing, commercially exploiting, reverse-engineering or creating derivative works without prior express authorization.
29. Third-party services and liquidity providers
Arberion may integrate, use or rely on third-party services, including liquidity providers, custodians, payment processors, oracles, cloud providers, compliance partners and blockchain networks.
Arberion is not responsible for losses, unavailability, delays, errors, failures or damages caused by independent third parties, except where the responsibility arises from a non-waivable legal obligation.
30. Limitation of liability
To the maximum extent permitted by applicable law, Arberion will not be liable for losses or for direct, indirect, incidental, special or punitive damages, lost profits, consequential losses or any prejudice arising from:
- market volatility;
- investment decisions made by the user;
- temporary unavailability of the platform;
- internet, power, hardware or software failures;
- failures of blockchain networks;
- acts or omissions of third parties;
- intrusions, cyber attacks or external fraud;
- incorrect sending of assets by the user;
- operational error of the user;
- failures of liquidity providers or integrated services.
Nothing in this document excludes liability that cannot be legally excluded.
31. No warranties
The platform is provided "as is" and as available, without express or implied warranties of fitness for a specific purpose, uninterrupted availability, absolute security, absence of errors, full compatibility or economic outcome.
Arberion does not warrant that the platform will operate without interruptions, delays, vulnerabilities or technical failures.
32. Indemnification
You agree to indemnify, defend and hold harmless Arberion, its partners, officers, employees, partners and affiliates from any losses, costs, expenses, liabilities, fines, judgments or claims arising from:
- breach of this document;
- misuse of the platform;
- infringement of third-party rights;
- illicit or abusive conduct;
- false or omitted information provided by you.
33. Force majeure
Arberion is not responsible for delays, failures, unavailability or losses arising from events of force majeure or fortuitous events, including, without limitation:
- war;
- terrorism;
- sanctions;
- strikes;
- pandemics;
- blackouts;
- large-scale cyber attacks;
- generalized infrastructure failures;
- collapse of blockchain networks;
- acts of public authorities;
- extreme natural events.
34. Changes to these terms
Arberion may modify, update or replace this document at any time to reflect regulatory, technological, operational or commercial changes.
Changes will take effect as indicated by the platform. Continued use of the platform after the effective date of the changes will be interpreted as acceptance of the new version.
35. Communications and notices
Official communications may be made by email, in-app notification, notice on the website, internal account message or any other channel indicated by Arberion.
Notices sent to the data registered by the user will be considered valid, and it is the user's responsibility to keep them up to date.
36. Dispute resolution and arbitration
Without prejudice to the right to seek administrative or judicial relief when required by law, Arberion may establish a contractual mechanism of mediation, prior negotiation or arbitration for the resolution of disputes, in accordance with applicable legislation and any specific convention adopted.
In the absence of a valid and specific arbitration clause, disputes will be submitted to the competent court defined in the jurisdiction clause.
37. Jurisdiction and applicable law
This document is governed by and interpreted in accordance with the laws of the jurisdiction in which the company operating the platform is validly incorporated, without prejudice to public order rules and mandatory provisions that may apply.
The competent courts of that jurisdiction are elected to settle any disputes arising from this document, except where the law provides for a different forum.
38. General provisions
Any tolerance by Arberion regarding the breach of any obligation will not constitute a waiver, novation or contractual amendment.
If any clause of this document is held invalid, illegal or unenforceable, the remaining provisions will remain valid and effective.
This document may be supplemented by specific policies, risk notices, product rules and additional terms applicable to certain features.
